Singapore just handed down its first-ever prosecution for unauthorised works on a conserved building, and the bill is steep: a $250,000 fine for the individual, $150,000 for the owning company, more than $400,000 combined, plus a court order to restore the building at the company's own cost. The shophouse at 32 Desker Road had stood for more than a century; a single illegal renovation stripped away heritage that can never be put back.

This matters even if you'll never own a shophouse, because it redraws the line on what you can and can't do to an old building you buy, and where the liability lands when you get it wrong.

In October 2022, the buyer purchased the shophouse in the Little India Conservation Area, one of four districts where Singapore applies its strictest conservation controls, through a company. At the time, the building was in original form, including a rare first-storey residential façade typical of shophouses built around 1913 to 1914. Despite knowing conservation permission was required, the parties engaged workers directly to convert it into a co-living development without URA's approval. A January 2023 inspection caught the breach; by then, original features had already been demolished.

This is the first prosecution for unauthorised works on a conserved building since the Planning Act was amended in 2017 to introduce tougher penalties. Here's how the penalties fell:

The maximum exposure is sobering: under the Planning Act 1998, offenders face a fine of up to $500,000, or up to 12 months' imprisonment, or both.
